FBI Director James Comey has said that Hillary Clinton should receive no charges in connection with using her private email server for official business, including the exchange of classified documents.
“Although the Dept. of Justice makes final decision on matters like this, we are expressing to Justice our view that no charges are appropriate in this case,” he said during a press conference on July 5. “…There is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.”
“Prosecutors necessarily weigh a number of factors before deciding whether to bring charges.”
At the beginning of his speech, James Comey said that FBI was “referring the matter to the Dept. of Justice for a prosecutive decision.” He also noted that the investigation was made “honestly,” “independently,” and “apolitically.” However, the FBI Director refused to answer questions from reporters live on camera.
Last week, a senior Justice Dept. official reported that Attorney General Loretta Lynch, who was appointed by Clinton and elevated by Obama, reserved the right to overrule the decision of FBI about Hillary Clinton.
“From a senior DOJ official: Attorney General Lynch reserves the right to overrule the recommendation of career prosecutors and the FBI in the Hillary Clinton email probe,” Mark Halperin from Bloomberg tweeted. “This official says the probability she would overrule is ‘very, very low,’ but it is not zero. So the ‘news’ is she will not recuse, despite the firestorm.”
