Libya: Gaddafi Offside, Cannot Run For Presidency

Saif Al Islam Gaddafi will not be able to run for the presidency of Libya. Rais’ son’s candidacy in the December 24 elections was cut by Hnec, the Libyan National Electoral High Commission (HNEC). On the last day to present the candidacy, the competitors had reached the record number of 98 politicians in the running to lead the Libya of the future. Only two women presented the application. The HNEC offices had registered 73 candidacies in the HNEC’s Tripoli office, 12 in Benghazi and 13 candidates in Sebha.

Of the 98 candidates, HNEC revoked 25 applications. In addition to Saif al Islam, current Prime Minister Abdul Hamid Mohammed Dbeibeh, former Prime Minister Ali Zeidan, former Gaddafi Chief of Staff Bashir Saleh, former Chief of the General National Congress (GNC ) Nuri Abusahmain.

Saif al Islam was disqualified due to a final criminal conviction and for not obtaining a certificate due to the absence of previous judgments. Ali Zeidan will not be able to run for the presidency due to dual citizenship.

Even more delicate is the matter concerning the exclusion from the competition of the current prime minister. Dbeibah was excluded due to a decision by the Tripoli Court of Appeal, which accepted two appeals against the candidacy of the current prime minister. The first appeal was presented by presidential candidates Aref Al-Nayed, Othman Abdeljalil, Mohammed Al-Muntasser and members of the Libyan Political Dialogue Forum Ahmed Al-Sharkasi and Al-Saida Al-Yakoubi, while the second appeal was presented by candidate president and former interior minister Fathi Bashagha.

The candidacy of General Haftar also remains in the balance. Two appeals have been filed against him. The first was rejected, while the second has yet to be examined.

All excluded candidates can appeal within three days from the decision of the Courts. Saif’s appeal to Islam Gaddafi is pending in the Sabha court. The judges did not meet to decide, deserting the session called for Sunday morning. The stop to Saif’s candidacy for Islam is creating tensions. General Haftar’s LNA military forces are pressing Sabha’s judges to back down and give the go-ahead for the candidacy. But the rules of the game are in the hands of the High Electoral Commission. It is almost impossible to see Gaddafi’s son compete in the next elections on December 24th.
